Abstract

This thesis will undertake a comparative study of the new Singapore Ship Sale form with the Norwegian Saleform 1993. The Norwegian form is chosen for comparison as it is the most widely used standard ship sale form today and it will be interesting to see what are the changes brought about by the Singapore form. The paper will focus on how the two sale forms regulate the seller’s obligations for the delivery and the condition of the vessel on delivery and the seller’s promise to deliver the vessel free of certain encumbrances. This will be done by (i) analyzing the main clauses regulating these events under the Singapore form, (ii) comparing how these events are being provided for under the Norwegian Saleform 1993 and (iii) discussing the legal implications for both the seller and the buyer.
